These Terms of Service (“Terms”) govern the use of services (“Service”) provided by ThirtyFive B.V. (“we,” “our,” or “us”). By accessing or using the Service, you agree to these Terms.

1. Scope of Service

• 35Local provides optimization and management for Google My Business profiles.

• Future expansion may include other platforms such as Apple Maps, Yandex, Yelp and additional directories.

• The Service covers optimization, reporting, review management, and insights, but not paid advertising unless explicitly agreed.

2. Eligibility

• The Service is available to companies of all sizes: SMEs, large enterprises, and franchise chains.

• By signing up, you confirm you are authorized to represent the business entity.

3. Account and Access

• Clients must connect their Google account to enable service.

• You are responsible for account security and limiting access to authorized personnel.

• We are not liable for unauthorized access due to compromised credentials.

4. Pricing and Billing

• Subscription fees apply per store location, with three tiered packages (Basic, Pro, Premium).

• Clients may choose monthly or annual billing. Annual subscriptions may include discounts.

• Enterprise customers with multiple locations may receive custom pricing agreements.

• All payments are due in advance and are non-refundable, unless required by law.

5. Client Responsibilities

• Ensure business information is accurate and lawful.

• Comply with Google My Business and other third-party platform policies.

• Notify us promptly about unauthorized access, errors, or service issues.

6. Limitations of Service

• We cannot guarantee exact search rankings, as visibility depends on multiple external factors.

• Downtime may occur due to Google API limitations, scheduled maintenance, or third-party outages.

• The Service does not include liability for loss of profits, reputation, or indirect damages.

7. Data and Privacy

• All data handling is subject to our Privacy Policy.

• We only process anonymized usage metrics and business listing data.

• No personal customer data is collected or retained.

8. Intellectual Property

• All software, designs, and materials of the Service are owned by ThirtyFive B.V. or licensors.

• Clients retain rights to their own business content (e.g., logos, photos, descriptions).

9. Termination

• Clients may terminate by written notice; services end at the close of the billing cycle.

• We may suspend or terminate accounts for breach of Terms, unpaid fees, or misuse.

• Upon termination, business data will be deleted within 60 days in line with our Privacy Policy.

10. Governing Law

• These Terms are governed by the laws of The Netherlands.

• Exclusive jurisdiction lies with the courts of Amsterdam, The Netherlands.

11. Updates to Terms

We may revise these Terms to reflect service changes or legal requirements. Continued use of the Service after updates constitutes acceptance of the new Terms.
